Mediation is defined as a process of assisted negotiations. It is a procedure in which the parties discuss their disputes with the assistance of a trained impartial third person(s) who assist them in reaching a settlement. Unlike litigation where a judge or jury makes a final decision that is thrust upon the parties, mediation is a collaborative effort in which all parties participate in problem solving and in reaching a final resolution. Mediation is confidential and can be much more cost effective than formal litigation. It is also not bound by the formal rules of evidence which allows information to flow more freely and in a more timely manner.
